Resolution to Hire a Highly Technical Consultant for the LEED Certification of the Clark International Airport New Passenger Terminal Building 

 

WHEREAS, The Bases Conversion and Development Authority is currently undertaking the Clark International Airport (CIA) Expansion Project, a construction of a world-class International Airport Complex inside the Clark Civil Aviation Complex (CCAC).  For the first phase of the project, it aims to construct a New Passenger Terminal Building (NPTB) that will be able to handle the projected traffic volumes and passenger capacity of eight (8) million passengers a year. This project targets to service the growing catchment area up North, hence, will potentially help ease air traffic congestion at the Manila International Airport;

WHEREAS, the first hybrid public-private partnership project under the Duterte Administration,the CIA-NPTB is on its way in achieving EDGE accreditation, which is targeted to be received by March 2020;

WHEREAS, aside from EDGE accreditation, BCDA aims for the CIA-NPTB to be LEED Building Design and Construction (New Construction) and/or LEED Operations and Maintenance Gold Certified;

WHEREAS, Leadership in Energy and Environmental Design (LEED) is the most widely used green building rating system in the world and was developed by the non-profit organization U.S. Green Building Council (USGBC). LEED Certification is a globally recognized symbol of sustainability achievement;

WHEREAS, LEED for Building Design and Construction (LEED BD+C) provides a framework for building a holistic green building, giving the stakeholders the chance to nail down every sustainability feature and maximizing its benefits. LEED for Operations and Maintenance (O+M) offers existing buildings an opportunity to pay close attention to building operations by supporting whole buildings and interior spaces that have been fully operational and occupied for at least one year. LEED helps build high performing buildings by focusing on both performance-oriented sustainable strategies and outcomes;

WHEREAS, BCDA aims to have the Clark International Airport New Passenger Terminal Building certified in the LEED BD+C and LEED O+M component;.

WHEREAS, BCDA requires a consultant with highly technical knowledge, experience and skills in the management of LEED accreditation for the CIA-NPTB;

WHEREAS, The Officer-In-Charge of the Project Management Department, in an internal memorandum dated 18 November 2019 endorsed to the Bids and Awards Committee for Consultancy (BAC-C) the engagement of a LEED Certification Consultant who shall render the following services:

  1. Facilitate a LEED kick-off meeting with key persons and stakeholders of the project from pre-design phase to construction phase to address the prerequisites and credit activities to be assigned to the responsible parties;

  2. Conduct a Feasibility Study to assess and identify the LEED Certification track to be applied for the CIA-NTB;

  3. Establish a project timeline and form focus groups for each LEED credit category, and establish regular communication channel and protocols with assigned project team members and owner;

  4. Recommend design strategies, green standards, and guidelines that will help in achieving LEED Certification prerequisites and credit requirements;

  5. Conduct regular LEED meetings and site visits;

  6. Compile necessary LEED documentation and facilitate LEED Documents submission to GBCI;

  7. Submit an accomplishment report on a monthly basis for approval by the President and CEO.

  8. Conduct trainings for the Operations and Maintenance Contractor to maintain the facilities as per the LEED certification international standards.

 

WHEREAS, the approved budget for the abovementioned consulting services for a term of six (6) months is Pesos: Three Hundred Sixty Thousand and 00/100 (PhP360,000.00), inclusive of all applicable taxes and fees;

WHEREAS, Section 48.2 of the Revised IRR of RA 9184 reiterates the general rule that public bidding is the general mode of procurement, the same section allows procuring entities to resort to alternative methods of procurement in highly exceptional cases and subject to the conditions required by RA 9184, its Revised IRR, and applicable guidelines. Among these highly exceptional cases is Negotiated Procurement of Highly Technical Consultants under Section 53.7 of the Revised IRR;

WHEREAS, Section 53.7 of the Revised IRR of RA 9184 allows negotiated procurement as a mode of procuring the services of “individual consultants hired to do work that is (i) highly technical or proprietary; or (ii) primarily confidential or policy determining, where trust and confidence are primary considerations for the hiring of the consultant…” in this case, the main consideration for hiring the consultant is the highly technical work involved;

WHEREAS, the  end-user desires to engage the expertise of Mr. Eugene Ryan Badere as LEED consultant being a specialist in various sustainable design frameworks, circular economy and new technologies. Mr. Badere is a certified LEED Green Associate and has extensive experience in project management and implementation of sustainable and green developments.

 

WHEREAS, the end-user attests to the following qualifications of Mr. Eugene Ryan Badere.:

 

  1. Mr. Badere is a Green Building Consultant wherein he was able to build a management tool with visualization to author projects efficiently and centrally utilizing Kanban, Lean, and Integrated Project Delivery principles. He is a specialist in various sustainable design framework, Circular Economy and new technologies (DLT, Blockchain, Internet of Things, etc.)

 

  1. He has certifications from the following:

    1. LEED Green Associate from the Green Business Certification Inc.;

    2. Cradle to Cradle Certified Catalyst from the Cradle to Cradle Products Innovations Institute;

    3. Building Performance Analysis from Autodesk Inc.;

    4. Autodesk Student Expert (Alumni) from Autodesk Inc.

 

  1. He has trainings from the following:

    1. Sustainable Urban Development from the Amsterdam Institute for Advanced Metropolitan Solutions;

    2. Designing Cradle to Cradle Products for the Circular Economy from the Cradle to Cradle Products Innovations Institute

 

WHEREAS, pursuant to Section 53.7 of the Revised IRR of RA 9184, the term of the individual consultant shall, at the most, be on a six-month basis, renewable at the option Head of the Procuring Entity (HoPE), but in no case shall exceed the term of the latter;

WHEREAS, pursuant to Section 54.6 of the Revised IRR of RA 9184 highly technical consultants are mandated to register with PhilGEPS and provide a PhilGEPS Registration Number as a condition for the award of the contract;

NOW, THEREFORE, we the members of the Bids and Awards Committee for Consulting Services, hereby RESOLVE, as it is hereby RESOLVED:

  1. To recommend the procurement of the services of a LEED Certifications Consultant through Negotiated Procurement of Highly Technical Consultants under Section 53.7 of the Revised IRR of RA 9184; 

  2. To recommend the award of contract to Mr. Eugene Ryan Badere with a professional fee of  Pesos: Sixty Thousand and 00/100 (PhP60,000.00) per month, inclusive of all applicable taxes and fees, for a period of six (6) months from the date indicated in the Notice to Proceed and/or contract, renewable at the option of the appointing HoPE, but in no case shall exceed his term;

  3. To require the consultant to register with the PhilGEPS and provide a PhilGEPS Registration Number;

  4. To direct the end user to request for the issuance of the Certificate of Funds Availability (CFA) for the procurement prior to the award of the contract; and

  5. To direct the end user to furnish the BAC-C Secretariat original copies of the duly conformed Notice of Award, Notice to Proceed and executed contract.
