RESOLUTION TO HIRE A CONFERENCE  CONSULTANT UNDER NEGOTIATED PROCUREMENT OF HIGHLY TECHNICAL CONSULTANTS

WHEREAS, on November 23, 2018, the BCDA Group held, for the first time, the BCDA Group Planning Forum with a theme "Raising the Bar". It was attended by more than forty (40) representatives from Planning Services Departments across all BCDA subsidiaries. The forum resulted in the creation of the BCDA Planning Guideline which was primarily aimed to align planning practices, planning and budget calendars across the BCDA Group. 

WHEREAS, upon consultation with BCDA Chairperson Gregorio Garcia, he recommended to conduct a BCDA Group Conference and Training cum Team Building to create "one common language" among the BCDA Group and to develop one BCDA culture to increase employees' passion towards work, impact productivity and over-all performance of the BCDA Group.

WHEREAS, the BCDA Chairperson would like this activity to be dynamic, solicit insights and utmost participation from the attendees, rather than just sit and listen to lengthy lectures. Moreover, he wanted to make the participants reflect on their potential and value as an employee, and when they return to their workplace, these participants will have the renewed passion and clear sense of purpose towards their work.

WHEREAS, to ensure that BCDA is proceeding in the right direction to achieve its conference objectives, a highly-technical consultant needs to be engaged to facilitate the BCDA Group Conference composed of : one (1) consultant to facilitate the discussions, workshops and fora in the BCDA Group Conference.

WHEREAS, the Head of the Office of the Corporate Planning Services, in a memo dated 8 October 2019, endorsed to the Bids and Awards Committee for Consulting Services (BAC-C), the engagement of a Consultant who shall render the following services:

  1. Conduct Pre-work activities such as conduct research about BCDA and its subsidiaries, draft segment methodology and concept, among others;

  2. Facilitate the conduct of TED-talks and workshops on One Common Language/ Vocabulary;

  3. Lexicon of One Common Language/ Vocabulary for the BCDA Group;

  4. Report on the proceedings of TED-talks and workshops;

  5. Final Report on the assessment of the BCDA Group Conference/Training, including recommendations for next steps. This will be considered in the next BCDA Group Training activities;

  6. Other activities deemed necessary for the conduct of the BCDA Group Conference;

  7. Other activities as enumerated in the approved Terms of Reference (TOR).

WHEREAS, the approved budget for the abovementioned consulting services is Pesos: Six Hundred Fifty Thousand (PhP 650,000.00), inclusive of all applicable taxes, fees and other charges;

WHEREAS, Section 48.2 of the Revised IRR of RA 9184 reiterates the general rule that public bidding is the general mode of procurement, the same section allows procuring entities to resort to alternative methods of procurement in highly exceptional cases and subject to the conditions required by RA 9184, its Revised IRR, and applicable guidelines. Among these highly exceptional cases is Negotiated Procurement of Highly Technical Consultants under Section 53.7 of the Revised IRR;

WHEREAS, Section 53.7 of the Revised IRR of RA 9184 allows negotiated procurement as a mode of procuring the services of “individual consultants hired to do work that is (i) highly technical or proprietary; or (ii) primarily confidential or policy determining, where trust and confidence are primary considerations for the hiring of the consultant…” in this case, the main consideration for hiring the consultant is the highly technical work involved;

WHEREAS, the engagement of Mr. John Carlo R. Valenzuela as conference consultant for the conduct of the BCDA Group Conference activities was recommended due to his expertise in creating award winning brand campaigns, pushing companies to successfully penetrate the digital business and his unique expertise in knowing East and Western Brand Disciplines will likewise benefit BCDA as he brings in best practices from his previous consultancies;

WHEREAS, pursuant to Section 53.7 of the Revised IRR of RA 9184, the term of the individual consultant shall, at the most, be on a six-month basis, renewable at the option of the appointing Head of the Procuring Entity (HoPE), but in no case shall exceed the term of the latter;

WHEREAS, pursuant to Section 54.6 of the Revised IRR of RA 9184 highly technical consultants are mandated to register with PhilGEPS and provide a PhilGEPS Registration Number as a condition for the award of the contract;

NOW, THEREFORE, we the members of the Bids and Awards Committee for Consulting Services, hereby RESOLVE, as it is hereby RESOLVED:

  1. To recommend the procurement of the services of a Conference Consultant through Negotiated Procurement of Highly Technical Consultants under Section 53.7 of the Revised IRR of RA 9184; 

  2. To recommend the award of contract to Mr. John Carlo R. Valenzuela with a total consultancy fee of Pesos: Five Hundred Seventy Two Thousand Pesos (PhP 572,000.00), inclusive of all applicable taxes, fees and other charges for a period of six (6) months from the date indicated in the Notice to Proceed and/or contract, renewable at the option of the appointing HoPE, but in no case shall exceed his term;

  3. To require the consultant to register with the PhilGEPS and provide a PhilGEPS Registration Number;

  4. To direct the end user to request for the issuance of the Certificate of Funds Availability (CFA) for the procurement prior to the award of the contract; and

  5. To direct the end user to furnish the BAC-C Secretariat original copies of the duly conformed Notice of Award, Notice to Proceed and executed contract.
