BAC-C RESOLUTION NO. BC-2019-047

 

HIRING OF A HIGHLY TECHNICAL CONSULTANT FOR THE 

BCDA GROUP TRAINING AND TEAM BUILDING ON ONE COMMON LANGUAGE


 

WHEREAS, pursuant to the approval of the President and CEO on 03 October 2019, there is a need to create "one common language" among the BCDA Group and to develop one BCDA culture to increase employees' passion towards work, impact productivity and over-all performance of the BCDA Group;

 

WHEREAS, the BCDA Group Training and Team Building on One Common Language will be conducted in November 2019 to the Planning Services Departments of BCDA and the BCDA subsidiaries;

 

WHEREAS, a highly-technical consultant needs to be engaged to lead and facilitate the BCDA Group Training and Team Building on One Common Language in November 2019 to ensure that the activity will proceed according to the objectives;  

 

WHEREAS, the end-user endorsed to the Bids and Awards Committee for Consulting Services (BAC-C), the engagement of a Consultant for the said BCDA Group Training and Team Building on One Common Language with an approved budget for the contract (ABC) of Six Hundred Twenty Thousand (PhP620,000.00), inclusive of all applicable taxes, fees and other charges;

 

WHEREAS, Section 48.2 of the Revised IRR of RA 9184 reiterates the general rule that public bidding is the general mode of procurement, the same section allows procuring entities to resort to alternative methods of procurement in highly exceptional cases and subject to the conditions required by RA 9184, its Revised IRR, and applicable guidelines.  Among these highly exceptional cases is Negotiated Procurement of Highly Technical Consultants under Section 53.7 of the Revised IRR;

 

WHEREAS, Section 53.7 of the Revised IRR of RA 9184 allows negotiated procurement as a mode of procuring the services of “individual consultants hired to do work that is (i) highly technical or proprietary; or (ii) primarily confidential or policy determining, where trust and confidence are primary considerations for the hiring of the consultant…” in this case, the main consideration for hiring the consultant is the highly technical work involved;

 

WHEREAS, the end-user desires to engage the expertise of Mr. Masikap L. Fontanilla, Jr.  as consultant and facilitator to the BCDA Group Training and Team Building on One Common Language in November 2019;

 

WHEREAS, the Consultant shall render the following services:

 

  1. Develop the concept of the Training and Team Building on One Common Language that will accomplish the following:

 

  1. Draw out the purpose in life of the participants

  2. Ensure that diversity is advantageous to the organization

  3. Utilization of talents and skill-set for an efficient and effective performance in in the organization. 

 

  1. Training and Team Building materials including certificates of attendance/participation;

  2. Conduct of the Training and Team Building on One Common Language to meet the following objectives:

  1.  To gain a deep understanding of the self, character, needs, values, and purpose in life.

  2.  To align corporate goals, objectives, and campaigns in achieving One BCDA.

  3. To rationalize and improve communications flow through the program “matrix” clearly, easily, and willingly.

  4. To discover one’s purpose in life and inherent talents and skill-set that will benefit the organization.

  5. To alleviate blocks and unearth undesirable experiences of the past through the utilization of experiential concepts, methodologies, and training tools.

  1. Final Report on the assessment of the BCDA Group Training and Team Building on One Common Language, including recommendation for next steps;

  2. Conduct of individual one-on-one sessions and/or group sessions with the Team Building participants to track the development of participants;

  3. Other activities deemed necessary for the conduct of the BCDA Group Training and Team Building on One Common Language;

  4. Other activities as enumerated in the approved Terms of Reference (TOR).

 

WHEREAS, the end-user represents to the BAC-C that Mr. Masikap L. Fontanilla, Jr. is qualified as a highly technical consultant having the following qualifications:  

 

  1. He has fifteen (15) years of experience of consultancy work helping employees discover their potential and increase their sales and customer retention.

  2. He has certifications from Points of You Academy, Gallup Clifton Strengths, TetraMap International and Graham Nicols, London.  These are training schools for personal and team developments whose approach is unique and different from the conventional training schools.

  3. He is the only Filipino consultant certified to conduct the Points of You Training.

  4. He is the only consultant who offers together the three (3) innovative tools Points of You, Gallup and TetraMap in the Philippines.  

 

WHEREAS, pursuant to Section 53.7 of the Revised IRR of RA 9184, the term of the individual consultant shall, at the most, be on a six-month basis, renewable at the option of the appointing Head of the Procuring Entity (HoPE), but in no case shall exceed the term of the latter;

 

WHEREAS, pursuant to Section 54.6 of the Revised IRR of RA 9184 highly technical consultants are mandated to register with PhilGEPS and provide a PhilGEPS Registration Number as a condition for the award of the contract;

 

NOW, THEREFORE, we the members of the Bids and Awards Committee for Consulting Services, hereby RESOLVE, as it is hereby RESOLVED:

 

  1. To recommend the procurement of a Highly Technical Consultant for the BCDA Group Training and Team Building on One Common Language through Negotiated Procurement under Section 53.7 of the Revised IRR of RA 9184; 

  2. To recommend the award of contract to Mr. Masikap Fontanilla, Jr.  with a total consultancy fee of Five Hundred Forty Thousand Pesos (PhP540,000.00), inclusive of all applicable taxes, fees and other charges for a period of six (6) months from the date indicated in the Notice to Proceed and/or contract, renewable at the option of the appointing HoPE, but in no case shall exceed his term;

  3. To require the consultant to register with PhilGEPS and provide a PhilGEPS Registration Number;

  4. To direct the end user to request for the issuance of the Certificate of Funds Availability (CFA) for the procurement prior to the award of the contract; and

  5. To direct the end user to furnish the BAC-C Secretariat original copies of the duly conformed Notice of Award, Notice to Proceed and executed contract.
